Welcome to Bebop, www.bebop.app, and our app. Here and on the referenced pages, you will find the User Agreement applicable to the services provided and the use of Bebop. These services are provided via mobile applications and our website (the Bebop app and www.bebop.app respectively); henceforth, we refer to both our provided services and the site and applications as our “Service”. As soon as you begin using Bebop/our Service, you must accept our User Agreement; we therefore advise you to read it thoroughly and carefully first.
This User Agreement provides, on the one hand, the conditions for the legal relationship between Bebop and its Users and, on the other hand, the basic conditions which, subject to alternative agreements, serve as the starting point for the agreement between the Customer and the Bebopper.
Dutch law applies to the User Agreement and Service.

3. What is Bebop?
Bebop is a platform that connects supply and demand. Bebop enables Customers to have their tasks carried out by Beboppers. Customers are individuals or companies who want to outsource tasks (such as odd jobs and errands), the Task-givers. individuals who want to perform these tasks for a fee, the Tasker-takers. Bebop easily connects Customers and Beboppers through a mobile application; users must possess a smartphone with an internet subscription, running on the iOS or Android operating system.
In this User Agreement, we use the terminology Customer and Bebopper for the respective users of the Service. Customers give the details of the Tasks e.g. the place and time, summary of the work involved and the fee offered. Beboppers are then free to respond and accept or not.
The fee is the amount Beboppers receive for performing the work; this fee should encourage Beboppers to accept the Customer's tasks. The Customer determines the amount. If no one responds, the Customer can change the amount at any time. The entire fee goes to the Bebopper. This makes it transparent what the Bebopper earns. Bebop only earns money form the sale of Credits.
Customer and Bebopper can keep each other informed of changing circumstances (such as changes in delivery time, or items) through push notifications and a chat. We advise both Customer and Bebopper to use these and to communicate clearly and quickly to avoid complications.
In the case of grocery shopping, Beboppers temporarily advance the total cost of the groceries. The Bebopper is refunded upon delivery, including the Bebopper's fee. This constitutes a transaction directly between Customer and Bebopper, without Bebop’s intervention.
In the case of tasks, the Customer communicates the fee; this can be an hourly rate or a fixed price. Upon completion of the tasks, the agreed amount is paid. This constitutes a transaction directly between Customer and Bebopper, without Bebop’s intervention. Customer and Bebopper choose, by mutual agreement, how they settle this amount. Bebop recommends electronic payment (for example, using the Tikkie application), though cash payment is also possible. For further explanation and tips on payment, we refer you to the Bebop site.
The Bebopper acts as the Customer’s representative when performing tasks. The agreement (“Assignment”) is formed directly between Customer and Bebopper. Bebop is explicitly not a party to this agreement and solely has a facilitating role. Therefore Bebop has no influence on the fulfillment of obligations between Customer and Bebopper. Bebop bears no liability or responsibility in this process, other than as stated in this User Agreement.
Bebop wants this process to run as smoothly as possible If you encounter any issues, as mentioned in Article 11, please contact us immediately at klantenservice@bebop.app
4. Your Account
4.1 To use the Service, the User is requested to create a user profile (the Account). The User agrees to provide truthful and complete information on their Account. The User will not provide any misleading information.
4.2 The User shall ensure that the information provided is complete, accurate, and up-to-date. The information provided will be deleted, modified, or supplemented as soon as it can be considered incorrect, incomplete, or misleading due to changed circumstances.
4.3 The User shall register only one Account. The account is personal and will only be used by the rightful owner of that account.
4.4 The User shall not share their login credentials with others, or grant others access to their Account in any other way. The User is solely responsible for access to their account and the confidential information shared with Bebop (i.e., personal details and account numbers).
4.5 Users under the age of 18 are expected to have permission from a parent or guardian before creating an Account. By accepting the User Agreement, the user guarantees that they are at least 18 years of age, or have permission from a parent or legal guardian.
4.6 To ensure the safety of its Users, Bebop reserves the right to identify the User. Pending this identification, Bebop may deny its Users access to the Service.
4.7 It is prohibited to use any photos, images or language in the Service that contain advertising, mention a website, contain statements that can be deemed offensive or political, express religious beliefs, infringe on the trademarks of others, and/or contain erotic content.
4.8 If, in Bebop's opinion, a User acts contrary to the letter or intent of the User Agreement, or what may reasonably be expected of a User, Bebop has the right to delete his or her Account and deny him or her access to the Service temporarily or permanently.
5. Bebop Credits
Bebop earns money from the orders and tasks placed by Customers; Customers purchase Credits. Depending on the number of Credits purchased, customers can use these to place one or several orders. Subscriptions are an exception: a monthly payment to Bebop allows customers to place an unlimited number of orders in that month. Prices for subscriptions and Credits include VAT.
Credit and subscription rates are subject to change. If an order is not accepted, or if the Customer cancels an order before it is accepted, the Credit will be refunded. Under no circumstances are Bebop Credits tradable, transferable, or exchangeable for cash. Credits are linked to individual Customer and Bebopper accounts. Individual Credits do not expire; purchased Credits always represent the same value (i.e., placing a task on the Service). Subscriptions provide unlimited access to the Service for each paid term.
6. Availability
6.1 Bebop is an open and independent platform and is not affiliated with pre-selected shops and/or retail chains. Therefore, the Customer is free to order products from any shop(s).
6.2 Bebop does not have an employment relationship with the Bebopper; therefore, Beboppers are free to respond, or not, to placed Tasks.
This also means that Bebop is theoretically available everywhere. However, Customers are dependent on a sufficient number of Beboppers in their region and vice versa. To ensure a good balance between Beboppers and Customers, Bebop regulates the regions in which the Service is available. The User can consult the Service for an overview of these regions.
7. The task
After the Customer has entered the task into the Service, the task is visible to the Beboppers. They then have the opportunity to accept this task. As soon as a Bebopper accepts the Customer's task, a binding agreement is created. This binding agreement between the Customer and Bebopper is also referred to as the Task. The Task is generally concluded under the following conditions:
7.1 The Task consists of the execution of the task and the fee agreed upon between the Customer and Bebopper on the Service.
7.2 Upon completion, the Customer owes Bebopper the agreed fee (plus any costs incurred by Bebopper) for the work.
7.3 The Customer and Bebopper will ensure that the Order is executed in accordance with the Bebop User Agreement.
7.4 The Customer will provide Bebopper with the assistance and information reasonably necessary to execute the Task.
7.5 The Customer and Bebopper will mutually observe Bebop's standards (see Article 17).
7.6 The Customer and Bebopper are free to agree on different or additional terms in the Task without Bebop's approval. However, this does not affect the provisions of the User Agreement between Bebop and our Users.
8. Grocery Delivery
8.1 The agreed-upon items will be delivered at the agreed-upon time and location, unless otherwise communicated.
8.2 If a specific item is unavailable, the Bebopper will notify the Customer via the chat function in the app. The Bebopper will not purchase the item in question and will not purchase an alternative item, unless the Customer indicates otherwise in the Task or via a message in the chat function.
8.3 The Bebopper must be able to provide proof of payment (receipt, invoice, bill, or other written or digital proof) to the Customer. If the Bebopper is unable to do so, the Customer is not obligated to accept and/or pay for the groceries.
8.4 The Bebopper must provide a copy or photo of this receipt/invoice. In the event of a dispute between the Bebopper and the Customer, this can be presented at any time as proof of services rendered.
8.5 Only after payment has been made does the Customer rightfully own the physical receipt/invoice and items.
8.6 In the event of a dispute, the Customer may be asked to present this receipt/invoice. If the Bebopper only has a digital invoice, receipt, or receipt, they will provide the Customer with a copy. This will serve as proof that the work has been performed and the groceries have been paid for.
We always recommend that Customers indicate in the Task whether Beboppers may purchase alternative products if the specified products are not available (see 8.2). The Bebopper has advanced the groceries from their own resources, and the advanced amount will be paid to the Bebopper, plus the agreed-upon fee. The receipt/invoice/other proof of payment will only be transferred after payment has been made. This allows the Customer and Bebopper to prove payment has been made in the event of a dispute. The Customer and Bebopper will decide in mutual consultation how payment will be made; this can be done in cash or via a digital transfer.
Bebop strongly recommends that Bebopper and the Customer make digital payments; this ensures there is always proof of the transaction. In the case of cash payments, the Customer is responsible for ensuring that the receipt, invoice, or other proof of payment is in their possession (the "immediate transfer" principle).
Once the work has been completed to the satisfaction of both the Customer and Bebopper, both will indicate in the application that the Task has been successfully completed. This means the transaction is successfully concluded for the Customer, Bebopper, and Bebop. Bebop strives to facilitate communication between the Customer and Bebopper as much as possible. However, the quality of the execution of the task is a matter between Bebopper and the Customer. If the Customer is not satisfied with the quality of services provided, or the Bebopper is not satisfied with the further handling of the Task, then the Customer must contact Bebop via the app or email (see: www.bebop.app/contact).
9. Delivery of Alcohol and Tobacco Products
Tobacco products and alcoholic beverages are only delivered to persons aged 18 or older, by persons aged 18 or older. Users provide their valid date of birth when creating their Bebop account. The Bebopper can only deliver tobacco products or alcoholic beverages to persons aged 18 or older. If it appears that a User has provided unlawful personal data, including date of birth, Bebop will immediately suspend the account in question, without refunding any credits (i.e., credits and/or subscription fees).
10. Execution of the Tasks
Bebop can also be used to perform small tasks and chores. This includes chores such as gardening, tidying up, light cleaning, etc. Payment for work performed will be made after the work has been completed satisfactorily.
10.1 The Bebopper will carry out the Assignment at its own discretion, expense, and risk.
10.2 The Bebopper will perform the work in consultation with the Client's wishes, as set out in the Assignment, for the predetermined fee.
10.3 The Bebopper is responsible for:
The Bebopper will arrange its own transportation. If the Bebopper uses a motor vehicle, the Bebopper must possess a valid driver's license and third-party liability insurance.
The Bebopper will adhere to the applicable agreements and rules of the Bebop User Agreement and the Task between Bebopper and the Client when carrying out a Task.
The Bebopper will handle the Client's property with care.
The Bebopper will arrange for the necessary insurance, as there is no employment relationship between Bebop and the Bebopper. Any material, immaterial, or personal injury that occurs directly or indirectly during the execution of a task is the sole responsibility of the Bebopper.
10.4 The Customer is responsible for:
The Customer is responsible for a safe working environment. If the Customer cannot guarantee a safe working environment, the Bebopper has the right to refuse or cancel the assignment.
Sufficient financial resources to purchase the delivered products and/or services.
10.5 Bebopper and the Customer will keep each other informed via notifications within the app, should anything change to the originally placed task. Bebop is exclusively intended for performing small tasks (e.g., mowing a lawn or washing a car). The Service may not be used to have work performed, including but not limited to:
Work that is permanent in nature (i.e., hiring someone for an extended period/multiple days or at set times).
Working with hazardous substances (pesticides, toxins, carcinogens, allergens, mutagens), viruses, or bacteria.
Working with radiation, in places with noise (on average more than 85 dB), vibrations, or under excessive pressure.
Work that violates local or national laws in any way.
Night work (between 10:00 PM and 6:00 AM).
Work of a sexual nature.
10.6 The work is in accordance with applicable legislation. It is the Customer's responsibility to ensure the Bebopper's age is respected, and the Bebopper must only accept assignments they are authorized to perform. If there is any doubt about the Bebopper's age, the Customer may ask them to identify themselves with valid identification.
10.7 If it appears that the Service is nevertheless being used for activities that are not permitted, Bebop will immediately suspend the account in question, without refunding any credits (i.e. credits and/or subscription fees).
11 The Customer cancels
If no Beboppers have (yet) accepted the submitted task, the Customer may cancel the task. Credits will not be refunded if the Customer cancels after the task has been accepted. Once the task has been accepted, it can only be canceled (without Credit refund) in a limited number of cases:
The Bebopper has accepted the groceries but has not yet purchased any products.
The Customer can cancel tasks (such as odd jobs) up to 30 minutes before the agreed-upon time. If this time is exceeded, the Customer is obligated to pay the Bebopper an hourly rate, or the agreed-upon amount.
In all other cases, the Customer is obligated to pay the Bebopper the full agreed-upon amount. If the Customer cancels orders repeatedly, Bebop reserves the right to immediately suspend or block the relevant account at any time, without refunding any Credits (i.e., Credits and/or subscription fees).
12 The Bebopper cancels
If the Bebopper is unable to complete the order for any reason, the Bebopper is obligated to cancel it as soon as possible and inform the Customer. The Bebopper will also inform Bebop of the reason for the cancellation. In this case, the Customer's credit will be refunded. If a Bebopper fails to show up at all without canceling, the Customer's credit will be refunded. In the aforementioned cases, Bebop will then contact the Bebopper and issue a warning if necessary. Bebop reserves the right at all times to immediately suspend or block the Bebopper's account in these cases, without refunding any credits (i.e., credits and/or subscription fees).
13 Non-personal use of the Service
Companies can use Bebop for simple tasks and on a non-regular basis. However, non-personal use of our Service by organizations such as delivery services, cleaning companies, and/or other businesses is not permitted without the explicit permission of Bebop.
Online platforms, or other businesses are not permitted to create a personal account on Bebop. This includes platforms that match online supply and demand. Bebop will determine whether this is the case. Bebop reserves the right to block users in the event of a violation of this provision (at Bebop's sole discretion). In that case, the offending user will not be entitled to a refund of purchases. Your account will be deleted, and users with whom you have come into contact will be informed of the violation, if Bebop deems it necessary. In the event of such a violation, an immediately payable and non-mitigable fine of €1,000.00 (one thousand euros) will be due.
14 Conflicts
There are several conceivable situations in which a conflict may arise between Bebopper and the Customer. Bebop will, if necessary, act as a mediator between the Customer and Bebopper. Bebop will apply the preceding and following rules:
14.1 If the Customer and/or Bebopper are dissatisfied with the outcome of the work and cannot reach a resolution, a conflict exists. The Customer and/or Bebopper will indicate this in the application; at that point, a conflict officially exists between the two parties, and Bebop will act as a mediator.
14.2 In case of grocery delivery: if one or more items are damaged, the Customer is not obligated to pay for the items in question; the Customer will pay the Bebopper the agreed-upon amount (the sum of the items and Bebopper's compensation) minus the price of the damaged items.
14.3 If the Bebopper has purchased other items/products (e.g., a different brand or product) without consulting the Customer, the Customer is not obligated to purchase the items in question. The Customer shall pay Bebopper the agreed amount (the sum of the items and Bebopper's fee) minus the price of the incorrect items. The Customer is obligated to accept the items if they are the correct items, but with a different content/weight than specified, provided the difference is no more than 25%. In this case, the Customer shall take a photo of the receipt so that Bebopper can return the items in question.
14.4 If Bebopper has performed the work poorly or not as agreed, the Customer and Bebopper shall reconsider, in consultation, what constitutes a reasonable compensation for the work performed..
14.5 If Bebopper fails to deliver the groceries at the agreed time, Bebopper applies the following rules:
Delivery up to 30 minutes after the agreed time: Bebopper will be paid in full as agreed in advance.
Delivery from 31 to 60 minutes after the agreed time: Bebopper will receive half of the agreed fee.
Delivery from minute 61 to 120: the Bebopper will not receive the agreed-upon payment.
Delivery from minute 121: the Customer is not obligated to accept the groceries from the Bebopper; the Bebopper will not receive the agreed-upon payment.
14.6 If the Customer is unable or unwilling to pay the Bebopper for the groceries including the fee at the time of delivery, provided that this has also been demonstrably performed correctly, Bebopper is not obligated to actually hand over the groceries and proof of payment. The Bebopper must report the dispute to Bebop and, if necessary, return the groceries. Bebop then reserves the right to recover the relevant or remaining amount from the Customer on the Bebopper's behalf, plus any administrative and transaction costs incurred. This will initially be done by sending a payment reminder. If the Customer still fails to pay after this reminder, Bebop will initiate an out-of-court debt collection procedure.
14.7 If the Customer is unable or unwilling to pay Bebopper for the work performed at the time of completion of the work, provided that it has also been demonstrably performed correctly, then the Bebopper must immediately report the dispute to Bebop. Bebop subsequently reserves the right to recover the relevant or remaining amount from the Customer on behalf of the Bebopper, plus any administrative and transaction costs incurred. This will initially be done by sending a payment reminder. If the Customer still defaults after this reminder, Bebop will initiate an out-of-court debt collection process
14.8 To the extent the Bebopper's liability is not covered by their insurance, The Bebopper’s liability is limited to direct damages up to an amount of five times the fee agreed upon with the Customer, with a maximum of EUR 250.00. Direct damages do not include consequential damages, lost profits, lost savings, or loss of data.
14.9 If the Customer or Bebopper fails to comply with the User Agreement, Bebop reserves the right to terminate the relevant account without refunding any credits and/or subscription fees.
14.10 Bebop will always rely on evidence that can be provided either digitally or in writing. The Customer and Bebopper will each provide a clearly documented report of the dispute
14.11 In the event of a dispute between Bebopper and the Customer, Bebop is the point of contact and can be reached at: klantenservice@bebop.app

Using false personal details e.g. address, date of birth, account number, or any other personal data.
Intentionally entering incorrect and misleading information through the Service (i.e. placing false or misleading tasks).
Accepting tasks and then not executing them. The Bebopper may cancel tasks as stated in Article 12. However, accepting tasks without executing them is considered abuse of our Service.

The Bebopper shares the information obtained about tasks and customers with third parties, or has third parties perform work.

16.3 Bebop is entitled, without further notice of default and without the need for judicial intervention, to charge the User of our Service an immediately non-mitigable fine of €250.00 (in words: two hundred and fifty euros) per act of misuse, whereby the misuse of (personal) data, photo or other Material is jointly considered as one act, without prejudice to Bebop's right to take further legal action against the User and to claim compensation for damages incurred as a result of misuse by the User.

If one or more provisions of the User Agreement are found to be invalid, the remaining provisions will remain in full force and effect.
24 Our Service changes regularly
Bebop will regularly update the Service and its content. All material on our Service may be out of date at any time. Bebop is not obligated to update this material.
25 Force Majeure
Bebop is not liable for failure to fulfill or delay in fulfilling obligations under our User Agreement if there is a potential force majeure event. Force majeure refers to all events reasonably beyond Bebop's control. Such causes include, but are not limited to: emergencies, power or internet outages, fire, theft, sabotage, vandalism, strikes, etc.
26 Liability & Indemnification
26.1 Bebop is not involved in the execution of Tasks and therefore has no control over the proper fulfillment of any obligation under these Tasks. Therefore, Bebop is in no way responsible or liable for any damage suffered, whether material, immaterial, personal, or financial, as a result of the services provided, any shortcomings or damage during the execution of the Task, or the breach of any other obligation. Bebop and the Service only have a facilitating role.
